-- Kevin smith of Kevin Smith, Attorney at Law, recently engaged in an oral argument before the Connecticut Supreme Court in an effort to show why a Bridgeport superintendent should not be allowed to continue in his position. Smith was joined by his co-counsel and former legal partner, Norm Pattis, for the matter.
According to court documents, the superintendent, Paul Vallas, was hired in 2011 after the state's education officials dissolved Bridgeport's locally elected school board. A new board was created with members who were appointed by Connecticut. However, the Connecticut Supreme Court ruled that the state did not have the authority to dissolve the board and reinstated the elected members, whose terms had not yet expired.
At least one of those members, and a city activist, hired Smith to petition the court for the removal of Vallas. Smith, who normally handles criminal defense and DUI cases, argued that Vallas did not have the full qualifications, which the state of Connecticut requires by law. Vallas came to Connecticut after running school districts in Chicago and Philadelphia. The state's education board allowed him to take an abbreviated program rather than complete a 13-month course to earn a leadership certificate.
A Superior Court judge agreed with Smith's arguments. Smith filed another motion to lift a temporary stay on the order, stating that it would be better for the students if a new superintendent were brought on before the beginning of the school year. He also pointed out that the immediate vacate order would not harm the superintendent financially, as the superintendent was expecting a $1 million payout for consultation work he performed. Again, the judge agreed with Smith, ordering Vallas to immediately vacate his office.
However, supporters of Vallas, including the mayor of Bridgeport, subsequently asked the state's Supreme Court to review the case. Oral arguments took place on September 23, 2013, and the firm now awaits a decision on the matter.
