against the city, alleging racial discrimination and harassment.
The officer, who is of Mexican heritage, was subjected to numerous offensive remarks including racial slurs and anti-Hispanic statements. Despite reporting the disparaging comments on multiple occasions to the city's police chief, no action was taken against the officer's supervisor. In addition to the verbal harassment, the officer's superior also abused him physically, including intentionally bumping into him. Such treatment and lack of response from his superiors may be a violation of the Civil Rights Act of 1964.
The officer was fired in March 2012 following an unrelated incident. After a review of the circumstances surrounding his dismissal, an arbitrator decided that the officer deserved the right to return to the force because the city did not provide just cause for his firing. Still, the city is fighting the arbitrator's ruling and the officer remains unemployed.
Once the Equal Employment Opportunity Commissioner investigated the allegations and issued a right-to-sue letter, the officer and his attorneys at the Law Offices of Joshua N. Karmel filed the lawsuit against the city. In total, the officer is seeking in excess of $600,000 for two different violations of his rights.
