Legal Mandates

At present, all fifty states and Washington D.C. have laws requiring special car seats for children who meet certain criteria.

For example, in Georgia children under the age of eight and less than 57 inches tall must ride in a child safety seat, a rear seat if one is available. The fine for a first offense is $50. By contrast, the law in Florida is all children under the age of three.

Further, 48 states have laws on the books requiring booster seats for children who have outgrown their safety seats but are still too small for a normal-sized adult seat. Florida and South Dakota are the only states without these laws.

Some people assume that if a child is improperly restrained and is then hurt in a crash that the driver responsible for the crash can get out of paying for the child's personal injury.
