Colorado DUI: Think carefully before taking a plea bargain

Unless a prosecutor is willing to drop the DUI charge altogether, there are usually two options available to a person - taking their case to trial or agreeing to a plea deal.

Earlier this month, DUI charges were filed against a police officer in Colorado Springs after he crashed his car. According to The Denver Channel, the officer's blood was taken at a nearby hospital but it is unknown whether he was exhibiting signs of being under the influence of alcohol or was administered other tests. His charges involve DUI per se, DUI and careless driving.

Plea deals are a popular method used to resolve cases according to the American Bar Association. A plea deal is an agreement drawn up between the prosecuting attorney and defense team where a person agrees to plead guilty to a lesser crime. The plea bargain process can be a complicated one as there are generally several factors that can come into play such as the severity of the charges, prior criminal record and strength of evidence.

DUI plea bargains

One of the things that people should be aware of when it comes to DUI plea bargains in Colorado is that an alcohol-related charge cannot be fully dismissed unless a prosecuting attorney's evidence is simply not strong enough to convince anyone that the person is guilty of drunk driving, according to the Boulder County Bar Association.

That being said, there are situations where DUI plea bargain may be the best option. However, a person should carefully consider the positives and negatives of the bargain before agreeing to it.


A plea bargain can be of great benefit to a person who has been accused of a serious crime or multiple DUI charges. These benefits include:
- A shorter sentence.
- Reduced charges.
- Faster processing and resolution of the case.
- Reduced penalties.
- Fewer court costs.

When a person has committed a serious felony DUI offense or faces multiple charges, a plea bargain can provide them a way to negotiate with the district attorney in an effort to spare others or to move forward with their life.


While a plea bargain may seem like a great solution, there are some things that people should keep in mind when considering one. One of the biggest disadvantages of a plea bargain is the fact that the case and evidence will never be reviewed by a jury according to Frontline. Another issue is that innocent people often choose to accept a plea bargain because of pressure.

When a plea bargain is being discussed, many times defendants believe that the evidence gathered against them is stronger than it really is. Prosecutors are not likely to divulge the full extent or reveal that the evidence is not that strong. When people are facing DUI charges, they should discuss all aspects of their defense and their available options with an experienced attorney.
