MIAMI, FL, February 26, 2014 /24-7PressRelease/
-- Millions of people suffer from tinnitus, a ringing or buzzing in the ears that does not go away. Those with the condition will do almost anything to get rid of their symptoms. One man even had a doctor cut the nerves to the ears to stop the dreaded noise. However, the only thing that changed was the man's ability to hear anything but the ringing and buzzing. Extreme examples like this illustrate the lengths to which patients will go to find relief.
Homeopathic Medicines Fill The Vacuum of Treatment Options For Tinnitus Patients
As there is often little that conventional medical treatment can do to relieve the condition, many tinnitus patients have sought relief through so-called "natural" or homeopathic remedies. NaturalCare, Inc manufactures one homeopathic remedy, RingStop eardrops. The product, which claims to stop ringing and buzzing in the ears, is widely reviewed on consumer websites. Although there were numerous positive reviews on a variety of websites, the negative reviews outweighed those that praised the product for its efficacy.
It is not easy to determine the precise ingredients in RingStop. According to the company's website, RingStop "contains the highest quality, all-natural proprietary homeopathic formula in strict compliance with the Homeopathic Pharmacopeia of the United States..." The guide sold with the product is more specific about the ingredients than the company website, but how those ingredients act to help the condition is s unknown.
Class Action Lawsuit Against NaturalCare
RingStop was the subject of a class action lawsuit in California alleging that NaturalCare had violated the state's False Advertising and Unfair Competition laws. The plaintiffs stated that the product did not reduce ringing or buzzing in their ears as the product packaging had promised. The class sought compensatory damages.
Unfortunately for those searching for relief, the case was recently dismissed because the lead plaintiff had no standing to file. The judge found that Alisa Neal lacked standing because she had failed to disclose the class action in a Chapter 7 bankruptcy filing - an action that rendered her ineligible. In order to have standing, plaintiffs must show economic damages. In Ms. Neal's case, her bankruptcy estate -- not she -- would have received the damages had the case been successful. If the bankruptcy estate and not Ms. Neal had filed the claim, the case might have moved forward.
You Still Have Other Legal Options - Contact An Attorney Today
Although the class action was dismissed because of the technicality, individuals who believe that they were harmed by taking RingStop - either physically or economically -- can still file claims against NaturalCare.
