-- Man admits guilt in fatal DUI crash on YouTube
Social media plays an important role in today's world. Many people in Orlando use it to share photos, daily events and personal interests. One man has used it as an outlet to admit guilt in a fatal DUI
The video has attracted national attention after it was posted in early September. According to CBS News, the man talks about the accident that resulted in another man's death, saying that he would "take full responsibility" and plead guilty when he was charged.
Controversy over the video
The alleged purpose of the video was to encourage others to avoid drinking and driving while also making an apology to the victim's family. The video generated a large response from viewers who voiced their support for the man and support for his willingness to do the right thing.
However, others have claimed that the video is more self-serving, stating that admitting his guilt could influence a judge to hand him a lighter sentence. After the man was charged with aggravated vehicular homicide
, he surprised his many supporters and the initial judge when he pled not guilty, according to the New York Daily News. The judge was angry with the plea, given the existence of the video, and one of his supporters wrote that he should get the maximum sentence possible.
Guilty plea and a prison sentence
The most recent development in the case was a change of judges, a guilty plea entered by the man and a prison sentence of over 6 years, according to Fox News. Six months of the sentence was for the DUI while the rest was for the vehicular homicide charge. In addition, the man's driving privilege was permanently taken away from him. The sentence was lighter than the 8.5 years he was originally facing but still indicates the severe penalties that come with a felony DUI conviction.
The man does not have a personal recollection of the crash. He told the court that he blacked out from heavy drinking but could not remember just how much alcohol he had consumed. He suffered a fractured skull and there was some speculation over whether he was the victim of a brain injury.
Defense against allegations
When someone is accused of driving under the influence, it is important for that person to present a defense. A good defense plan involves the following:
-Examining any health conditions which could mimic drunk driving.
-Making sure the person's legal rights were not violated.
-Determining whether the officer had the right to stop the driver; that the driver was committing a traffic offense at the time of the stop.
-That the evidence is untainted.
-Examining whether the evidence was gathered correctly.
Having a defense plan can ensure that someone receives a fair trial. Sometimes people may not actually be guilty of drunk driving and a thorough investigation can prove it. In such cases, a person should discuss his or her rights and legal options with an experienced attorney.
