Tampa Divorce Attorney Settles Tough Military Divorce Case Involving Child Support, Permanent Alimony, and Military Pension

He had been married for 18 years with multiple children when he and his wife had decided to get a divorce. He then approached Tampa's Denmon & Denmon Trial Lawyers for legal assistance.

The military husband's exposure comprised of child support, permanent alimony, and half of his entire military pension, which included the cost of living adjustments among others. He was earning a monthly income of $6,500 (taxable) and $2,500 (non-taxable). The wife's first settlement offer sought permanent alimony, more than 50% of the marital assets, and half of the husband's military pensions.

Due to health problems, the wife requested for a heightened alimony, as she would be without military health care. With the appropriate paperwork, she was given a program similar to that of Cobra military health care, but at a fraction of the cost of private insurance.

Under Florida law, the wife was entitled to receive a share of his military pension. The attorneys at Denmon & Denmon aimed to minimize this share as much as possible, defining the amount of pension as a lump sum that could remain constant throughout the pension's life. Military pension has an annual COLA or cost of living adjustment that exceeds 3%, and the legal team wanted the military husband to maintain this entire COLA on an annual basis.

Thanks to Denmon & Denmon, the case was resolved with 10 years of alimony, with the amount lowering substantially every few years. The military client was secured 150 overnights with the children, even if he moved out of the state as planned. Child support was resolved with a guideline amount.

The pension issue was resolved for a fraction of the client's exposure. The client was able to keep the COLA for retirement, and did not have to pay the premiums of his Survivor's Benefits Plan.
