GEICO General Insurance Co. v. Virtual Imaging Services, Inc., Case No. SC12-905.
The question presented is whether PIP insurance companies can pay for health care services based upon the new Medicare fee schedule method instead of the "reasonable amount" method expressly promised in the insurance policy which was silent as to the fee schedule.
Greenspan Law Firm Attorney Harley Kane forcefully argued that GEICO's policy expressly promises to pay the "reasonable amount" without mentioning the fee schedule method. The District Courts have all held that a PIP insurer cannot rely on the fee schedule method of making payments which are substantially lower than required by the "reasonable amount" method without expressly adopting it in the policy.
