The Illinois Appellate Court was asked to review the decision regarding the case of Fifield, an employee of Premier. The lower court had ruled in favor of Fifield, who sought to have the restrictive covenant he signed with Premier tossed out. The appellate court reviewed arguments from both sides and agreed with the lower court's ruling. The higher court explained that a person must be employed for at least two years, under Illinois law, in order for the restrictive covenant to apply. In this case, Fifield worked for Premier under three months before resigning.
