-- The current Settlement Agreement covering the DePuy ASR XL and ASR Hip Resurfacing only applies to individuals who were implanted prior to August 31, 2013. Additionally, the individual must have had the ASR XL or resurfacing device for a minimum of six months before revision. If you have an ASR XL or ASR Hip Resurfacing and you were not revised prior to August 31, 2013 then your rights are not impacted by this Settlement. Therefore, if you were implanted with an ASR and you did not have a revision prior to August 31, 2013 (even if you have not yet had a revision and even if you are not currently experiencing any problems), a lawyer can help explain your legal options. Additionally, a lawyer can help protect against the statute of limitations expiring. Statutes of limitations are time restrictions in which to file a lawsuit. If your statute of limitations expires, you will be forever time barred from receiving compensation for the recalled hip implant. Therefore, if you or a loved one has been implanted with an ASR hip, do not wait until you or your loved one experiences symptoms, contact a lawyer immediately so that you can protect your rights.
Serious Injuries and Disabilities from DePuy ASR Hips
Friction or wear between two metal parts in a replacement hip can cause microscopic metal particles to be released into the patient's blood stream. These particles can cause a form of metal poisoning called metallosis, which can lead to severe pain, inflammation, pseudotumors and pseudocysts and other problems that may require costly and painful hip replacement revision surgery.
Patients who have received the DePuy ASR XL have reported a number serious injuries
and disabilities, including:
- Loosening of the implant
- Tissue death which is called necrosis
- Bone death which is called osteonecrosis
- Fractures of the bones around the hip implant
- Corrosion of the metal parts
- Fretting of the metal parts
- Allergic reaction
- Elevated metal levels in the blood stream
