-- Will it help to lower the national BAC limit?
For many years, the national blood alcohol content has been .08 percent. The National Transportation Safety Board is now recommending that the legal limit be changed to .05 percent, a suggestion that has caused many groups to speak out either in favor or in objection to the proposed change. Every state has the right to set its own legal limit for the consumption of alcohol, and many argue that the limit of .08 is enough to allow people to have a few drinks and still be able to drive safely.
A controversial suggestion
While some advocates for public safety support the recommendation, saying it will save lives, others disagree. They say the problem of drunk driving won't be solved by changing the BAC content, and that the real problem of habitual, "hardcore" drinkers isn't being addressed, according to NBC News.
USA Today says that an average-sized man can reach a blood alcohol content of .05 percent after only having three beers in an hour, while an average woman would reach the limit after having only two beers. The laws against drunk driving in Louisiana are strict. According to the State Legislature, a first offense can result in costly penalties
-A fine of $300 to $1,000
-Up to six months in jail
-Probation, including community service
-Enrollment in a substance abuse program
Lowering the blood alcohol content can mean that drivers who drink responsibly are suddenly put in the category of drunk driving. Surprisingly, MADD doesn't stand behind the NTSB's recommendation. Since only 8 percent of fatal accidents resulted from drivers whose BAC was between .05 and .08 percent, MADD says other methods of prevention would be more effective - such as changing ignition interlock laws
. Studies have shown that interlocks reduced drunk driving deaths by 36 percent in our state.
Getting help from an attorney
We have yet to find out whether Louisiana, or any state, will adopt new laws to lower the blood alcohol content level. But regardless of how much they had to drink, people who have been arrested for DUI deserve fair representation in court. If you have a drunk driving charge, it's important to get in touch with an experienced drunk driving defense attorney. An attorney will be able to help you understand what you're facing, as well as help you through this difficult and confusing time. Depending on your charges, a lawyer may be able to have some of your penalties lessened or even dropped altogether.
