After years of severe, chronic pain and 18 additional surgeries to repair damage caused by a defective vaginal mesh implant, a woman finally prevailed in a lawsuit this month against the manufacturer of the device, Johnson & Johnson.
Describing her life as a "living hell" since her 2006 surgery, the woman was awarded $3.35 million for compensatory damages by the jury. The award seeks to cover her actual losses incurred as a result of the initial failed surgery. Compensatory damages may include compensation for such losses as:
-Pain and suffering
The lawsuit continues as the jury considers an additional award of punitive damages -- damages that seek to punish or act as a deterrent for the manufacturer. Punitive damages may be awarded in an amount up to five times the amount of compensatory damages awarded to the former nurse.
The lawsuit is the first of more than 4,000 such cases against Johnson & Johnson which is only one of numerous manufacturers of transvaginal mesh implants. More than 30 additional manufacturers are also facing a multitude of lawsuits resulting from injuries suffered by the surgical implantation of the vaginal mesh.
The transvaginal mesh implants were first used in the 1990s and became a popular medical device for those who suffer from pelvic organ prolapse (POP). POP occurs from a weakening of a woman's pelvic muscles commonly following childbirth or menopause. The vaginal mesh implant was also used as an alternative to a hysterectomy.
Unfortunately, the device causes severe side effects and debilitating medical complications for thousands of women in Texas, Mexico and elsewhere around the world. Common symptoms include:
-Pain in vagina, leg, pelvis and lower abdomen
-Bleeding and infection
-Perforation of surrounding tissue and organs
-Constipation and incontinence
