The Domestic Relations Law S.170 defines the grounds for a divorce in the state of New York. "Irreconcilable differences" is not grounds for a divorce in New York. There must be proof of one or more of the following:

Constructive Abandonment: This means one of the spouses refuses sex with their partner for over a period of one year.
Cruel and Inhumane Treatment: The conduct of the defendant endangers the physical or mental well-being of the other.

Adultery: One partner has sexual relations outside the marriage.

Confinement: The spouse is in state prison for a period of three or more consecutive years after marriage.

Separation Agreement: The husband and wife have lived separate and apart pursuant to an agreement for a period exceeding one year.

Perhaps none of the grounds apply to you. In this case, a separation agreement for a period of one year can offer grounds for divorce.

Equitable distribution is the next bridge to cross. Then there comes the issue of the children. Custody, child support and visitation are the three concerns for the children.

Divorce can be a traumatic time in the lives of family members. Keeping things in perspective can be difficult but it's important. Anger is expected and a little anger is actually good. It helps to begin the process of separation and helps to move forward, thus beginning the healing process.
