"The Fair Debt Collection Practices Act (FDCPA) was passed to eliminate abusive collection practices and defines the guidelines under which debt collectors must conduct business," said Hoover. "Debt collectors often violate FDCPA laws, giving the debtor the right to sue the creditor or current debt holder and collect punitive statutory damages, which are $1,000 under federal law and $1,000 under state law. FDCPA representation helps protect our clients from these violations and may generate additional leverage when negotiating with creditors, allowing more rapid resolution to a client's debts.

The FDCPA and Debt Restructuring program offers national solutions for resolving client's debts. The new program is geared at helping clients overcome difficult financial times while helping the DAC debt settlement affiliates produce more client settlements in a shorter period of time.

The Oct 27, 2010 FTC ruling, which prohibits any debt settlement business from collecting fees upfront has caused many debt settlement companies to go out of business. Some offer a "performance model" or "no advance fee model" debt settlement, meaning they don't collect their fees until after a client's settlement has been is reached. However, many clients continue to be harassed by creditors even after being enrolled in a performance model debt settlement program, and often have no legal protection, resulting in wage garnishments or judgments. In these cases, both the client and the debt settlement company offering "debt settlement performance model" lost valuable resources and money in the process of debt settlement.

Hoover will be sharing information on the "FDCPA and Debt Restructuring" program along with their other debt settlement services, which include Attorney and Performance models, defaulted student loan resolution and tax settlement.
