Motio, Inc. Fires Back in Meritless Patent Lawsuit Filed by BSP Software LLC

Motio Cites "Mountains of Prior Art", Expects to Invalidate BSP Patents in BSP vs. Motio dispute.



    DALLAS, TX, April 27, 2012 /24-7PressRelease/ -- Motio, an award winning software vendor which offers products that streamline, optimize and extend IBM Cognos, aggressively responded to BSP Software LLC in a patent infringement lawsuit filed late last month by BSP in the Northern District of Illinois.

The patents at issue generally relate to the batch update of report specifications in a business intelligence environment (U.S. Patent No. 8,073,863; earliest claimed filing date February 2007) and the integration of version control in a business intelligence environment (U.S. Patent No. 7,945,589; earliest claimed filing date February 2009).

In a series of counterclaims, Motio alleges that both patents at issue are invalid and therefore unenforceable. Motio also asserts that its own prior commercial use of the techniques claimed in the patents began well before the patent applications were filed.

"We feel this lawsuit is merely an attempt by BSP to create confusion in the marketplace," said Lynn Moore, CEO of Motio. "We'd prefer to spend our time and energy innovating rather than litigating, but in the case of this lawsuit, we're not going to stand by and let BSP make false accusations or claim they are the innovator in a space to which they arrived several years late."

Beginning in 2003, Motio made a name for itself as the premier source of expertise in the area of Cognos extension, integration and customization. During the next five years Motio performed hundreds of Cognos SDK engagements many of which involved the batch manipulation of Cognos content or the addition of custom functionality inside of the Cognos user interface.

"In the case of these two patents, there are mountains of prior art which will clearly invalidate them," said Lance Hankins, CTO of Motio. "I'm sure IBM will be happy to know that BSP has recently patented techniques taught in several of the classroom exercises from the 2003 Cognos training material as well as the subsequent Cognos SDK samples," quipped Hankins.

Motio's flagship product, MotioCI provides version control, release management and automated testing for IBM Cognos. First released to the public in 2006, MotioCI has long supported version control for IBM Cognos environments, including the integration of version control functionality into the Cognos user interface. In 2009, BSP released a competing version control product, and filed a non-public patent application on the subject matter.

The patent claims made by BSP are not limited to IBM Cognos, but instead broadly claim applicability to many types of business intelligence environments.

"We're certain that other software vendors such as NOAD will be surprised to learn that in 2009, BSP claims to have pioneered the integration of version control into a business intelligence environment. NOAD has been doing this for Business Objects for over a decade. We are looking forward to shining a very bright light on this situation and invalidating both of these patents," said Hankins.
