Attorney Herman Martinez Helps Client Avoid SCRAM Device

Through careful negotiations, Attorney Herman Martinez was able to convince a Harris County Judge to reduce the sentence of a SCRAM device to the less costly ignition interlock device.



    HOUSTON, TX, August 30, 2012 /24-7PressRelease/ -- On Thursday, August 23, Houston DWI attorney Herman Martinez helped represent a client who had been arrested for their second DWI. During this case, a Harris County Judge had attempted to put a SCRAM device on the client as was his policy. This, however, is not required in the state of Texas and costs about $375 per month for all associated fees. Martinez took on the case and was able to get the Judge's court staff to contact the Judge at home to convince him to impose the Ignition Interlock Device (IID) as opposed to the more costly SCRAM device. This was effective and the client was able to walk away without installment of SCRAM.

In the state of Texas, many Judges are turning to the harsh penalty of having DWI offenders installed with the SCRAM device - which stands for the Secure Continuous Remote Alcohol Monitor. Unlike an IID which is installed on the vehicle of the offender, the SCRAM is installed on the person of the offender as a bracelet which must be worn 24/7. This device monitors the offender for alcohol constantly with readings that take place every thirty minutes. This data is then uploaded to the SCRAM base station per a determined schedule.

While the device has been proven to be effective in cutting down on repeat offenses, it is an extreme and expensive solution. For some offenders, it can be overkill. An alternative is the IID. This device is about the size of a modern cell phone and is attached to the engine of all vehicles owned and/or leased by the offender. It requires a breath test to start the vehicle, as well as irregular tests during operation. This has proven to be effective as well and is much less expensive - monthly costs ranging between $50 to $200, which is half of the cost of the SCRAM device at the very worst. At best, it's a seventh of the cost.
