Tampa Bankruptcy Attorneys Clark & Washington Discuss the Florida Consumer Collection Practices Act

Clark & Washington's Tampa bankruptcy attorneys explain your rights under the Florida Consumer Collection Practices Act.

TAMPA, FL, March 17, 2015 /24-7PressRelease/ -- The Tampa bankruptcy attorneys at Clark & Washington wish to discuss The Florida Consumer Collection Practices Act (CCPA). The act aims to prevent creditors and debt collectors from engaging in deceitful and abusive collection practices. The act also gives remedies to consumers who fall victim to creditors utilizing illegal collection practices.

The CCPA is Florida's version of the Fair Debt Collection Practices Act (FDCPA). The FDCPA achieves the same purpose as the CCPA but at the federal level. Each state can implement regulations that are stricter than the FDCPA, but the FDCPA sets the bar that each state must meet. For example, the FDCPA prevents creditors from calling third parties, calling your job, making threats and more.

The CCPA applies not only to companies that regularly engage in collection activities but also to debt buyers. This means that if a company buys a debt from another entity and then attempts to collect on that debt, they are still required to comply with the CCPA regulations. Some activities prohibited by the CCPA include, but are not limited to:

- Disclosing information concerning the existence of a debt that is know to be reasonably disputed by a debtor without disclosing the fact that the debt is disputed.
- Excessively communicating with a debtor or any member of a debtor's family.
- Using profane, obscene, vulgar or abusive language when communicating with a debtor or any member of a debtor's family.
- Making contact with a debtor between the hours of 9 p.m. and 8 a.m. without prior permission from a debtor.

If you ever find yourself being harassed by a debt collector, you are going to need an experienced Tampa bankruptcy lawyer with a specialty in creditor-debtor law to protect your interests. For more information or to schedule a free consultation, visit http://www.cw13fl.com.
