NFL Concussion Lawsuit Settlement Currently in the United States Court of Appeals for the Third Circuit

Concussion Settlement Payouts Delayed; Eligible Former Players Can Receive a Portion of Settlement Funding Now

SECAUCUS, NJ, September 16, 2015 /24-7PressRelease/ -- Atlas Legal Funding (www.AtlasLegalFunding.com) today announced that the NFL Concussion Lawsuit Settlement currently resides in the United States Court of Appeals for the Third Circuit. Previously, the court denied a motion for an expedited briefing schedule that would have helped to speed up the resolution of the case. Those appealing the Settlement reached between the NFL and the attorneys representing the retired NFL players were given until August 15 to file their appellate briefs with the court, and until September 15 to file their reply briefs. Those who have appealed will have until September 30th to respond. There is no date set for the Court of Appeals to hear the case or render their decision.

Ten Retired NFL Players Have Opposed the NFL Concussion Lawsuit Settlement; CTE Diagnosis Exclusion Main Reason for Opposition

Ten retired NFL players, who are part of the NFL Concussion Lawsuit Settlement, have filed their appellate briefs opposing the Settlement agreement that was approved by Judge Brody earlier this year. These appeals are based on the players' beliefs that the Settlement agreement is currently constructed unfairly and excludes former players who have yet to be diagnosed with CTE (Chronic Traumatic Encephalopathy).

The retired NFL players who opposed to the current Settlement agreement argue that the agreement does not account for thousands of players who are currently suffering from concussion-related symptoms that may eventually develop into neurological diseases -- and for those who one day may be diagnosed with CTE. Currently, the Settlement only provides compensation for a CTE diagnosis at or before the date the Settlement was finally approved by the District Court. Currently, there is no universal consensus on the ability to diagnose CTE before death, however the science and medical diagnosis related to CTE is steadily progressing. Currently the NFL settlement only recognizes a CTE diagnosis that's based upon an autopsy after death.

Appeal Will Delay Final Case Resolution and Player Compensation

The wait for those players who qualify under the Settlement agreement will have to wait for the appeals process to run its course for monetary awards to be disbursed. Ultimately, the appeal will delay any final resolution of the NFL Concussion Lawsuit Settlement and retired players receiving any compensation as a result.

Legal Funding Available Now for Former Players Available Through Atlas Legal Funding

Many former NFL players have had a hard time working and supporting themselves due to physical and neurological impairments caused by NFL injuries. For those who are currently under financial strain, the NFL Concussion Lawsuit Settlement and potential monetary compensation stemming from it is not just a luxury, it's a necessity. The time it will take for the Appeals and claims process to run its course and for funds to be disbursed to retired NFL players that qualify is still unknown. Because of this, many retired NFL players are left in limbo to figure out how to make it financially while they wait for the legal process to conclude.

However, this news is not all discouraging; players who qualify can receive a portion of their expected settlement funding now. Atlas Legal Funding is providing cash advances to former NFL players involved in the NFL Lawsuit Settlement under the current Settlement agreement while they wait for the case to resolve.
