Hawaiian Electric may have compromised evidence after the Maui fires by removing power poles, power lines and other equipment near where the Lahaina fires started. This is important because it happened before investigators were able to access the scene. This happened on August 12, 2023 before the investigators from the ATF arrived. Utility companies are supposed to follow national guidelines after a disaster like this to preserve evidence so investigators can accurately determine the cause of the fire.

In addition to removing evidence there are also questions surrounding why Hawaiian Electric didn't turn off power due to high winds. Maui County has filed a lawsuit against Hawaiian Electric for not turning off the power knowing high winds were expected and for not properly maintaining vegetation near the power lines and the substation. Multiple wild fire attorneys notified Hawaiian Electric that they needed to preserve evidence as early as August 10th. At this time Hawaiian Electric claims, they tried to preserve evidence but 3rd parties may have destroyed evidence outside of their control and that restoring power was their highest priority.
