New Surrogacy Regulations Allow for Use of Donor Gametes For Intended Parents Who Wish to do Surrogacy in India

The Ministry of Health and Family Welfare has announced major revisions to the surrogacy rules in India that will expand access for aspiring parents, including those opting to use an egg donor.



    NEW DELHI, INDIA, March 06, 2024 /24-7PressRelease/ -- On 21st February 2024, the Government of India has announced updates to the Surrogacy (Regulation) Rules, 2022. The new notification states: "In case when the District Medical Board certifies that either husband or wife constituting the intending couple suffers from medical condition necessitating use of donor gamete, then altruistic surrogacy using donor gamete is allowed."

The update states that for a couple to undergo surrogacy, both partners must contribute their own gametes. However, in cases where one partner has a medical condition that requires the use of donor gametes, surrogacy using donor gametes is allowed with the condition that the child must have at least one gamete from the couple.

Furthermore, Single women, including widows and divorcees, may also undergo surrogacy using their own eggs and donor sperm.

These updates aim to regulate and ensure the safety and ethical practices of surrogacy in India and assist those intended parents who need to use an egg donor/sperm donor.

In the latest development in the Surrogacy (Regulation) Rules, 2022, an amendment has been made to Form 2, paragraph 1, specifically targeting sub-paragraph (d). The revised regulation now stipulates that in surrogacy arrangements, the couple undergoing the process must provide both gametes, ensuring a genetic connection to the child. However, in cases where a medical condition affecting one spouse necessitates the use of donor gametes, surrogacy using donor gametes is permissible provided that at least one gamete originates from the intending couple. Additionally, single women, including widows or divorcees, seeking surrogacy must utilize their own eggs and donor sperm for the procedure to proceed. This amendment aims to regulate and streamline surrogacy practices while upholding the genetic integrity and rights of the individuals involved.

The notification added that the "surrogacy using donor gamete is allowed subject to the condition that the child to be born through surrogacy must have at least one gamete from the intending couple".
