A Lawyer's Advice on How Not to Get a DUI in Today's World
Experienced DUI attorneys understand that even the most upstanding citizens can find themselves in a situation where they might be faced with a virtually irresistible impulse to drive under the influence. Whether it be the result of poor planning, a sudden unexpected need to depart or a desire to blow off some steam, the need to get behind the wheel while intoxicated can arise with or without warning. It is exceptionally important to plan in advance for such situations. Essentially, every time you or the person responsible for your transportation plans to drink at any time in a given situation, it is important to have a back-up plan in place. You will then be prepared should you find yourself intoxicated and suddenly needing to leave the situation. Otherwise, you could be branded for life with the label and consequences of being an intoxicated driver.
Today's world is more pressure packed than at any point in history. Good, honest, and hard working people are struggling to get a degree, struggling to get a job, struggling to pay bills, and struggling to just survive. The reality is, is that some good, honest, and hard working people are losing their jobs, others losing their homes. Many of these people are not big drinkers, and in fact they may live an exemplary life when it comes to nutrition and exercise. The danger often comes however, when good people, who have worked hard, take a moment off to enjoy a rare outing, such as a concert, a sporting event, or a night on the town, with a few glasses of well deserved beer or wine. What ends up happening is that some of the finest members of our society say goodbye, by their cars, talking to their best friends about whether they are, "ok to drive". Many, after an honest reflection conclude that they are "ok" to drive. This might have nothing to do with whether or not their blood-alcohol content is a .08%, or more.
The key is that people must first identify, in advance, situations where they should know that they really are going to want to blow off some steam and have a number of drinks. As an example, if you have a friend who throws the best 4th of July barbeques, with the best of food and drink âEUR" should you go? I would say âEUR" of course you should, you've worked hard âEUR" you deserve it, but don't drive there! This brings us to the second step, the harder part that requires planning. You must plan to get there some other way, whatever you have to do, but don't drive to an event where you know you are really going to want to blow off some steam with a number of drinks over the course of the afternoon or evening.
Unfortunately, what ends up happening too often is that good people, with their vehicles at hand, get hit with the, "irresistible impulse to drive", (because they have to get their car to their driveway - so they can get to work the next day, etc.) This irresistible impulse to drive can be very strong and compelling. In today's pressure packed world, a sound way to avoid driving in violation of our DUI laws is to identify certain situations in advance and make it make it impossible to later decide that one is "ok" to drive.
