Certified Nurse Assistant Represented by Nichols Kaster, PLLP and Bohrer Brady LLC Files Overtime Lawsuit Against All Temporaries Midwest, Inc.

The complaint alleges that the staffing agency violated state and federal law when it only paid their Certified Nursing Assistants at a straight hourly rate for overtime hours worked



    MINNEAPOLIS, MN, April 05, 2017 /24-7PressRelease/ -- A current employee working as a Certified Nurse Assistant (CNA) at a nursing home, filed a lawsuit on March 30, 2017 against the staffing agency that employed her, All Temporaries Midwest, Inc. In her Complaint, she alleges that the staffing agency violated state and federal law when it only paid her, and others similarly situated, at a straight hourly rate for overtime hours worked, rather than at an overtime premium calculated at 1.5 times her regular rate of pay. The named plaintiff seeks unpaid overtime wages and double damages, and seeks to include in the case, other hourly/non-salaried healthcare workers who are similarly situated.

All Temporaries Midwest, Inc. is a staffing agency that provides workers in the health care field. Its related entities, All Temporaries Inc. d/b/a All Home Caring, and At Home With Care, were previously sued for a similar practice of paying straight-time only for overtime hours worked by their home health workers. That case is entitled, Allen v. All Temporaries, Inc. d/b/a All HomeCaring, and At Home With Care, Inc. No.16-CV-04409 (District of Minnesota).

Plaintiffs' attorney Michele Fisher of Nichols Kaster, PLLP explained, "Workers in this industry often work long hours caring for those who are unable to care for themselves, and should be fairly compensated when they work overtime doing so. This lawsuit, and the others we have filed, challenges what we believe to be an unfair and unlawful pay practice."
