    LIVERPOOL, ENGLAND, July 24, 2010 /24-7PressRelease/ -- In a rare case study, The Guardian has published an article on complaints about the complaint procedure. In the case study, a victim of Payment Protection Insurance (PPI) mis-selling by Barclays was being continually fobbed off by the bank in their claim for PPI compensation. Disgruntled by the bank's refusal to repay mis-sold PPI, the consumer approached the Financial Services Ombudsman (FOS) to escalate the case.

Once a claim is escalated to FOS, on average 8 out of 10 claims are successful. In this case study however, this was not the immediate case and the consumer received sporadic communication that the claim was still under review. Eventually after almost 17 months the claim was resolved in favour of the claimant who received compensation and interest.

Why then did FOS, champion of protecting consumers, take so long? It all boils down to an issue of volume. FOS have been inundated by the number of people making claims, partly due to the fact that significant press coverage and growing consumer awareness of their rights. Another significant factor is that banks, despite hugely negative press, still reject claims despite their legitimacy in an attempt to fob off claimants and gain themselves further time - while still holding on to consumers' money.
