-- An auto mechanic who had been arrested by the New York State Police on Transit Road, and charged with Driving While Intoxicated recently had the charges dismissed by a Town Justice, upon the motion of his attorney.
The police claimed the motorist had been driving his vehicle in the area of the Walmart shopping center and approached him while he was standing out side of his vehicle. The defendant admitted to driving the vehicle several hours earlier before consuming alcoholic beverages at a restaurant in the same shopping center. He was arrested and transported to the New York State Police Barracks where he blew a .25 on the Breathalyzer.

, successfully argued before the court that there was insufficient evidence of the motorist operating his vehicle contemporaneously with him being intoxicated, citing Article 60.50 of the NY State Criminal Procedure Law
The court agreed and dismissed the charges against the defendant. The motorist said outside the courtroom, ".....I am very grateful to Mr Sebastian who worked very hard on my case ..."
