Personnel Concepts Advises Employers that the ADAAA Throws Open the Disability Category for Reasonable Workplace Accommodations to Just About Everyone with More Than a Cold
The Americans With Disabilities Amendments Act (ADAAA) and enforcing regulations have so vastly expanded the category of disability requiring a reasonable workplace accommodation that just about everyone with more than a cold now qualifies.

    ONTARIO, CA, February 11, 2010 /24-7PressRelease/ -- The Americans With Disabilities Amendments Act (ADAAA), which took effect at the onset of 2009, makes it significantly easier for employees to request "reasonable accommodations" for a now-broadened definition of what constitutes a disability, Personnel Concepts advises employers.

The ADA Amendments Act was enacted with the goal of restoring the original intent of the Americans With Disabilities Act (ADA) of 1990 after a series of court rulings had restricted eligibility for disability accommodation. Under ADAAA, any impairment that might substantially limit a major life activity, even if treated and under control, now qualifies as a disability, and the burden is on employers to provide a reasonable accommodation rather than challenging the disability qualification.
