Registered trademarks are transferable property rights which can add value to a balance sheet and can substantially contribute to the success of a business and being a strong marketing tool that attracts customers. The registration can also be obtained up to 5 years before the brand is used giving owners security of mind.
There are a number of different applications to consider when protecting brands depending on where the business is trading or selling. A UK trademark application is one of the options available. However as Europe is a natural market for companies or individuals based in the UK, if a business intends to trade in the future in other EU countries, it is important to register from the start with the European Community mark. However the brand can be also protected in 79 countries via the Madrid Protocol which can be more effective in the long run if the brand will be global.
Once a trademark is registered there are no guarantees that a conflicting trademark will not also be entered on the trademark registers, bearing in mind that the UK and the Community Trademark system do not take earlier trademark rights into consideration. In reality it is very important for brand owners to monitor the trademark registers as well as to be alert for any common law usage of their trademarks that might occur, in order to maintain the exclusivity and value of their brand.
