The Stewart Law Firm, P.L.L.C. files a civil lawsuit for wrongful death caused by a Dr. Pepper employee when the truck he was driving collided with another vehicle killing the driver.

    AUSTIN, TX, September 30, 2008 /24-7PressRelease/ -- Stephen W. Stewart, founder of The Stewart Law Firm, P.L.L.C. in Austin, Texas, has filed a lawsuit in Henderson County, Texas State District Court on behalf of three (3) adult children that lost their father in a catastrophic motor vehicle collision. According to pleadings, on August 26, 2008, Dominique Taylor, an employee of The American Bottling Company, a subsidiary of Dr. Pepper/Seven Up Bottling Company, was operating a company truck traveling northbound on State Highway 274 when he failed to maintain a single lane of traffic, entering into the southbound lane of State Highway 274. When Taylor crossed over the center of the roadway, he caused his vehicle to violently strike the vehicle occupied and operated by Emmett Strickland in the opposite lane of travel. The result of the collision was that Emmett Strickland suffered massive trauma and injuries, which ultimately resulted in his untimely death. At the time of the collision, Taylor was acting as an employee of The American Bottling Company. Moreover, the motor vehicle operated by Taylor was owned by The American Bottling Company. In his lawsuit, attorney Stephen Stewart has alleged that Dominique Taylor was negligent, negligent per se, and grossly negligent in causing the head-on collision and resulting death of Emmett Strickland. The lawsuit alleges that The American Bottling Company is liable for the acts of its employee, Dominique Taylor. In addition, the lawsuit alleges that The American Bottling Company was negligent and grossly negligent in hiring, screening, training, and supervising Taylor. Finally, the lawsuit alleges that The American Bottling Company was negligent and grossly negligent in entrusting its motor vehicle to its employee, Taylor.

Regarding the recently filed lawsuit against Dr. Pepper and its employee, attorney Stephen W. Stewart explains that he is steadfast in the pursuit of justice on behalf of his clients. "When companies have operations that require employees to operate motor vehicles on public roadways, reasonable care should be taken to ensure that employees show due regard for the rules of the road. When those rules are not followed, tragic and sometimes, like in the case of the Strickland family, catastrophic events can occur. We intend to prosecute this case in the hope that we can make a difference as to how company operators of motor vehicles are hired, screened, trained, and supervised," states Stewart.
