Caroline Rule Recognized by Marquis Who's Who for Excellence in Law

An award-winning attorney who has been distinguished as a New York Super Lawyer every year since 2011, Ms. Rule brings with her more than three decades of experience and expertise in defending clients in matters that very often involve fraud allegations by federal and state governments. She represents clients facing criminal charges of alleged tax evasion, failure to file tax returns, filing false tax returns, bank fraud, health care fraud, money-laundering, and other white collar crimes. She also represents many clients in sensitive civil tax audits and investigations, as well as in complex civil litigation.

Known by clients and colleagues as a vigorous and determined advocate, Ms. Rule explains that she is driven to succeed because the outcomes of her cases can affect her clients for the rest of their lives. Today, Ms. Rule finds success as a partner of Kostelanetz & Fink, LLP, in New York, NY. She has been with the firm since 1996, during which time she has had notable successes, including one case where she represented the former head of KPMG's tax practice in what was then termed the largest tax fraud prosecution in United States history. Because of her leadership and expertise, Ms. Rule was able to obtain dismissal of the entire indictment on grounds of prosecutorial misconduct.

Considered an expert in her field, Ms. Rule shares her knowledge and insight through published works. She has authored a BNA Tax Management Portfolio, "IRS Procedures: Examinations and Appeals"; and numerous articles, including "United States v. Greenfield: A Triumph of the Fifth Amendment's Act of Production Privilege; or Confirmation that the Privilege Can Be Entirely Abrogated by Any Act of Congress or Even by a Treasury Regulation?," "How to Not Waive Privilege When Consulting Non-Attorney Experts or Professionals," and "Applying Civil Penalties for Willful Violations of FBAR Requirements."

Today, Ms. Rule continues in her professional development and influence through her involvement in various legal organizations. She is a member of the American Bar Association, where she serves as Chair of the Subcommittee on Tax Crimes of the Criminal Litigation Committee of the Litigation Section; and is a member of the Committee on Administrative Practice of the Tax Section. She is also a member of the Federal Bar Council Committee on Sentencing Reform and Alternatives to Incarceration, the Criminal Advocacy Committee of the New York City Bar Association, the Mass Incarceration Task Force of the New York City Bar Association, the New York Council of Defense Lawyers, and the National Association of Women Lawyers. She is also a Master of the Federal Bar Council Inn of Court.

Before pursuing a career in law, Ms. Rule was an artist. "I saw law school as a challenge, a way to prove that I could succeed in an area with which I was completely unfamiliar," she says. She did not expect that she would fall in love with the profession and achieve the success that she has today.

Ms. Rule holds a JD from Yale Law School, which she earned in 1989. After law school, she clerked for the Hon. John J. Gibbons, Chief Judge of the United States Court of Appeals for the Third Circuit. Previously, Ms. Rule earned a Master of Fine Arts (cum laude) from the San Francisco Art Institute, and a Bachelor of Fine Arts (with honors) from the University of Cape Town in South Africa. Ms. Rule is admitted to practice law in the states of New York and New Jersey; and before the U.S. Supreme Court, the U.S. Courts of Appeals for the Second, Third and Fourth Circuits, the U.S. Tax Court, and the U.S. District Courts for the Southern and Eastern Districts of New York. As she looks ahead to the future, Ms. Rule intends to continue working in the field of law while always remaining open to new opportunities.
