An accomplished tax controversies defense attorney, Mr. Fink has 50 years of professional experience in the legal profession. Serving as a partner at Kostelanetz & Fink LLP in New York City since 1994, he specializes in the areas of criminal tax and white collar controversies. Prior to this appointment, Mr. Fink was a partner at Kostelanetz, Ritholz, Tigue & Fink from 1987 to 1994, a partner at Kostelanetz & Ritholz from 1975 to 1987, and an associate at Kostelanetz & Ritholz from 1968 to 1975.
Alongside his primary endeavors, Mr. Fink has lent his time and expertise to a number of institutions and universities, and he has remained a respected lecturer in the field. Mr. Fink is an adjunct professor of law at the New York University School of Law Graduate Tax Program. In addition, he was a visiting professor of law at Peking University in Beijing, China. Locally, Mr. Fink donates to the American Civil Liberties Union, the Southern Poverty Law Center, the Anti-Defamation League, and the World Wildlife Fund.
To prepare for his illustrious career, Mr. Fink pursued a formal education at the University of Vienna, where he received a Diploma in 1962. He subsequently attended Brooklyn College, obtaining a Bachelor of Arts in 1965. In 1968, Mr. Fink earned a Doctor of Jurisprudence from New York University, where he later earned a Master of Laws in 1973.
A contributor of numerous books and articles to professional journals, Mr. Fink is a prolific author, having penned the two volume treatise "Tax Controversies: Audits, Investigations and Prosecutions," (LexisNexis, 37th revised edition in 2018). He also co-authored "How to Defend Yourself against the IRS" in 1987 and "You Can Protect Yourself from the IRS" in 1988. Mr. Fink also served as a department editor for the Journal of Taxation.
In an effort to remain aware of recent developments within the legal profession, Mr. Fink maintains affiliation with the American Bar Association, where he was chairman of the committee of civil and criminal tax penalties from 1983 to 1985, as well as the chairman of the task force for revision of tax penalties in 1982. Additionally, Mr. Fink has chaired the New York State Bar Association, Tax Section, Committees on Commodities and Financial Futures (1987-1988), Criminal and Civil Penalties (1981-1985; 1988-1990), Unreported Income and Compliance (1985-1987; 1990-1994) and Compliance, Practice and Procedure (1994-2003), and the New York State Bar Association, Commercial and Federal Litigation Section, Committee on Complex Criminal Litigation (1989-1991). Mr. Fink was also the Director of the New York County Lawyers' Association from 1989 to 1995 and the Chairman of the New York County Lawyers' Association Committee on Taxation from 1988-1992 and 1996-1997. He was a delegate in the New York State Bar Association, House of Delegates from 1994-1997. Mr. Fink has also served as an advisor for the United States Department of Justice, Tax Division, Advisory Committee on Tax Litigation from 1982-1984 and also served as Chairman of the IRS/BAR Liaison Committee, Northeast Region from 1996-1997.
In light of his exceptional achievements in law, Mr. Fink has accrued several accolades throughout his impressive career. Named one of New York Super Lawyers every year since 2006, he has also been named among the Best Lawyers in America every year since 1995. In addition, he holds an AV Rating through Martindale-Hubbell, the highest distinction available in the field of law and was the recipient of The ABA Jules Ritholz Memorial Merit Award in 2003 for "Outstanding Dedication, Achievement, and Integrity in the field of Civil and Criminal Tax Controversies", Chambers USA ranked him among the Highest Rating Tax Fraud Defender, named "superstar tax fraud defender," and he was recognized for his "litigation skill, insight into the government, and tremendous courtroom record." Notably, Mr. Fink is a fellow of the American College of Tax Counsel.
