Mr. Herman has been a partner of Covington & Burling LLP in Washington, DC, for the last five years, previously serving in the same position from 1994 to 2011 and as an associate from 1989 to 1994. He began his career as the international representative, organizing director, and assistant southern director of the Amalgamated Clothing Workers of America Union from 1973 to 1983. During this time, he also served a council representative of the American Federation of State, County, and Municipal Employees for two years. Years later, he became a law clerk under the Honorable Judge Irving L. Goldberg of the United States Court of Appeals for the Fifth Circuit in Dallas for one year before teaching as an assistant professor at the College of Law of Florida State University. He went on to become a general counsel of the Federal Election Commission from 2011 to 2013.

Mr. Herman earned a Bachelor of Arts from the University of South Carolina in 1983. He went on to obtain a Doctor of Jurisprudence from the School of Law at Harvard University three years later, graduating magna cum laude, and was then admitted to practice in the state of Pennsylvania in 1989. The following year, he was admitted to practice in three additional courts in the District of Columbia. Since graduating, he has gone on to serve in a number of volunteer roles such as in election campaigns for President Barack Obama and Senator Hillary R. Clinton. He was also a board member and chair of the Children's Law Center for four years, and has served on the board of directors for Bread for the City for the last two years.

In just a few short years, Mr. Herman resolved the first strike in the National Hockey League, represented the Mayor of the District of Columbia and negotiated collective bargaining agreements, and represented Federal Aviation Administrator James Garvey and negotiated the collective bargaining with the air traffic controllers union. More recently, he represented the state of Minnesota in a natural resources damages case that settled for $850 million, making history as the third largest natural resources damages case in the United States. He was named as a Champion by the Legal Times as well as Washington's Top Pro Bono Lawyer, and received special honors at the 2009 Servant of Justice Awards sponsored by the Legal Aid Society of Washington. He is listed in the 25th edition of Who's Who in American Politics and several editions of Who's Who in America, Who's Who in American Law, Who's Who in the East and Who's Who in the World.
