Willard Tom has had a major impact on the field of antitrust law, particularly as to the relationship between antitrust and intellectual property.

Over nearly 40 years of private practice and government service, Mr. Tom has had a major impact on the field of antitrust law, particularly as to the relationship between antitrust and intellectual property. From 1993 to 1995, he was counselor to the assistant attorney general of the United States Department of Justice, where he was one of the two principal authors of the Department of Justice and the Federal Trade Commission Antitrust Guidelines for the Licensing of Intellectual Property. Following that position, he served as Assistant Director for Policy and Evaluation of the Bureau of Competition of the Federal Trade Commission and then as Deputy Director of that Bureau. Later, he served as General Counsel of the Commission. In all of those positions, he remained deeply involved in matters involving intellectual property as well as a wide range of other matters involving anticompetitive conduct, particularly by dominant firms.

Mr. Tom has also had an impact through his scholarship. In 1992, he served as Editorial Chair for the third edition of the American Bar Association Antitrust Section's two-volume treatise, Antitrust Law Developments. In 1997, he and a co-author published Antitrust and Intellectual Property: From Separate Spheres to Unified Field, a major article analyzing the changing relationship between the two bodies of law over the course of the twentieth century. He has been an author or editor of over a dozen other works as well.

Mr. Tom has also been a partner in two major law firms (Sutherland, Asbill & Brennan from 1986 to 1993 and Morgan, Lewis, and Bockius, LLP, from 2000 to 2009 and 2013 to the present). In the former position, he argued an antitrust case before the U.S. Supreme Court in 1989.
Mr. Tom has been named among the Best Lawyers in America since 2005. An active mentor with the National Asian-Pacific Bar Association, they gave him the Daniel K. Inouye Trailblazer Award in 2017. Mr. Tom has been featured in numerous honors publications, including Who's Who in America, Who's Who in American Law, Who's Who in American Politics, Who's Who in the East, Who's Who in the World, and Who's Who of Emerging Leaders in America.

Mr. Tom has been a member of the District of Columbia Federal Judicial Nominations Commission, the Councils of the ABA Section of Antitrust Law and Section of Business Law, the American Law Institute, and the Administrative Conference of the United States. He has spoken at the Asian Competition Forum; the OECD; AIPLA; IPO; AIPPI, FTC/DOJ joint workshops; and various events in London, Brussels, Beijing, Shenzhen, Guangzhou, Hong Kong, Seoul, Taipei, and Tokyo.

Mr. Tom received his A.B. from Harvard College, cum laude, in 1975 and his J.D. from Harvard Law School, cum laude, in 1979.
