Mr. Kirby is renowned as a lawyer with more than 40 years of expertise in his field. He initially became interested in a career in law as a way to merge his talent for writing with his interest in politics and history. He later pursued an education at the University at Buffalo, a part of the State University of New York system, where he graduated with a Bachelor of Arts, summa cum laude, in 1979. Completing postgraduate coursework at Georgetown University from 1979 to 1980, he returned to the University at Buffalo to obtain a Doctor of Jurisprudence in 1982. Likewise, Mr. Kirby was admitted to practice law by the New York State Bar Association in 1983.

From 1983 to 1986, Mr. Kirby began his legal career as an associate of O'Shea, Reynolds, Napier, Quinn & Cummings in Buffalo. He later found success as a partner of the aforementioned firm from 1987 to 1993, at which point he accepted the post of a partner at Napier, Fitzgerald & Kirby in, where he would practice until 2006. From 2006 to 2012, he worked of counsel at Lippes, Mathias, Wexler, and Friedman, LLP. Since 2012, Mr. Kirby has excelled as the assistant attorney for Erie County.

Moreover, Mr. Kirby has authored several articles published in the New York State Bar Journal. He recalls his work taking over the school desegregation suit Arthur v. Nyquist and disqualifying the school board's requests for more money as a career highlight. He has been recognized by peer nomination for excellence in appellate law in the Buffalo Law Review, and was a judge for the University at Buffalo Law School's 2016 moot court. Furthermore, Mr. Kirby is a member of the Erie County Bar Association.
