From a young age, Mr. Kirby has been interested in politics and history. He also enjoyed writing and was particularly good at legal writing. He went on to receive a Bachelor of Arts, summa cum laude, in 1979 and a Doctor of Jurisprudence in 1982, both from the State University of New York at Buffalo, making him the first lawyer in his family. He is admitted to practice law in the State of New York, the U.S. District Court for the Western District of New York, the U.S. Court of Appeals for the Second Circuit and the Supreme Court of the United States.
Mr. Kirby began his career as an associate at O'Shea, Reynolds, Napier, Quinn & Cummings in 1983, where he later became partner in 1987. He then served as partner at Napier, Fitzgerald & Kirby between 1993 and 2006 and as of counsel for Lippes, Mathias, Wexler, Friedman LLP between 2006 and 2012. Today, Mr. Kirby is assistant county attorney for Erie County in New York.
For his efforts in law over the years, Mr. Kirby was recognized for Excellence in Appellate Advocacy by the Buffalo Law Review in 2007. In this sentiment, he also served as a judge in moot court at the University of Buffalo Law School in 2016. As a respected voice in his field, he has written several articles throughout his career. Most notably, one of his published articles resulted in the New York State Legislature amending a statute in accordance with the premise of his article titled, "The Six-Year Legal Malpractice Statute of Limitations, Judicial Usurpation of the Legislative Prerogative." He also successfully represented the former Mayor of the City of Buffalo in the Buffalo City School District federal school desegregation lawsuit, Arthur v. Nyquist, 716 F. Supp. 1484 (W.D.N.Y. 1989).
In his community, Mr. Kirby served on the City of Buffalo Police Reorganization Commission and the City of Buffalo Water Board. He maintains professional affiliation with the New York State Bar Association, the Erie County Bar Association and the Western New York Defense Trial Lawyers Association. Throughout his career, he has attributed his professional success to hard work, good fortune, having excellent mentors and his supportive wife, Susan Marie Kirby. Looking toward the future, Mr. Kirby plans to be fully retired.
