Mr. Schwartz's criminal practice has included a wide variety of charges, including charges of murder, manslaughter, rape, sexual battery, domestic violence, child molestation, elder abuse, stalking, assault with a deadly weapon, battery, driving under the influence, burglary, theft, drug offenses, vandalism, illegal possession of firearms, prostitution, lewd conduct, forgery, and building & safety code violations.
Mr. Schwartz began his legal career in 1988 as a civil litigator at Morrison & Foerster, where he worked on and tried complex cases across a wide range of matters in Federal and State Court. While at Morrison & Foerster, he was seconded to serve as a pro bono publico prosecutor through the Los Angeles County Bar Association's TAP Program.
Mr. Schwartz served as a criminal prosecutor at the Los Angeles City Attorney's Office from 1993 to 2018, trying a wide variety of cases. His trial conviction rate was 90%. In one year alone he tried 24 cases to verdict. From July 1995 to October 1999 he had a run of 67 cases in a row without a not guilty verdict. Mr. Schwartz took his role as a prosecutor very seriously, seeking justice in every case he handled. He was highly respected by opposing counsel, which included a pro per defendant whom he convicted of commercial burglary at an illegal political protest and then encouraged to go to law school, which the defendant did. Mr. Schwartz vouched for him when he took the California bar exam, which he passed. Now, the two of them serve as co-counsel on cases supporting free speech rights at legal political protests.
Mr. Schwartz earned a JD from the UCLA School of Law in 1987, where he participated in the Moot Court Honors Program and graduated in the top 15% of his class. During law school, Mr. Schwartz completed a Judicial Externship with the Honorable Irving Hill of the U.S. District Court, Central District of California, held Summer Associate positions at Sidley & Austin in Chicago and Morrison & Foerster in San Francisco, represented indigent clients pro bono in unemployment insurance hearings through a public service nonprofit organization, and taught "Street Law" at a public high school through an independent study program.
Mr. Schwartz earned a Bachelor of Arts, magna cum laude, from the University of California, Los Angeles in 1983. He majored in political science, with an emphasis in international political economics. He served as a teaching assistant in Professor Waldo Phelp's courses on the Rhetoric of Winston Churchill, Franklin Roosevelt, and Harry Truman, often guest lecturing for Professor Phelps. He graduated with College of Letters & Science Honors and was on the Dean's Honors List. Between college and law school, he worked at the Federal Bureau of Investigation in the Los Angeles Field Office.
Mr. Schwartz has received numerous accolades for his contributions to the legal profession as a trial lawyer and trial advocacy instructor. He was honored twice by the Los Angeles County Bar Association for his work with the Trial Advocacy Project and in 2016 was named "Prosecutor of the Year" by Mothers Against Drunk Driving. Additionally, Mr. Schwartz received the "Spirit of Adventure Award" in 1997 from American Youth Hostels, Inc., where he encouraged people to travel the world, furthering his fundamental belief that "travel is the vaccine and antidote to the poison of racial prejudice and religious intolerance."
Mr. Schwartz is deeply committed to civic and bar leadership. He served as President of the Barristers of the Los Angeles County Bar Association and held key roles in the Association, including serving as a member of the Board of Trustees and as a member of the Judicial Appointments Committee.
Mr. Schwartz is also a respected legal scholar, with many published articles on trial advocacy, evidence and expert witnesses, which have been featured in prominent journals such as Los Angeles Lawyer Magazine, where he was featured on its cover. While a prosecutor, he authored the chapter on Field Breath Testing in the California DUI Prosecutor's Manual.
Mr. Schwartz looks forward to continuing to serve as lead counsel in significant cases and remains committed to training the next generation of trial attorneys.
