Professor Whaley's distinguished career in legal education and commercial law spans several decades, marked by influential academic appointments and a profound impact on generations of law students. He currently holds the title of Emeritus Professor of Law at The Ohio State University Moritz College of Law, where he continues to write and revise his books.
Mr. Whaley's educational background laid a strong foundation for his professional achievements. He earned a Juris Doctor from The University of Texas at Austin in 1968 after completing a bachelor's degree at the University of Maryland in 1965. These academic experiences provided him with both the legal knowledge and analytical skills necessary for his later career as an educator and author. He attributes much of his success to discovering a field in which he has done well, and credits his personable nature, humor and unwavering commitment to student learning for his repeated recognition, receiving nine awards for outstanding teaching from three universities.
After practicing law in downtown Chicago following his graduation from law school, he accepted an invitation to teach a night course in contracts at Indiana Indianapolis Law School in early 1969, now known as the Robert H. McKinney School of Law at Indiana University. Despite initial nerves about the age difference between himself and his older students, Mr. Whaley quickly established rapport with the class, which then wrote a letter to the dean praising his teaching abilities. He soon transitioned to teaching daytime contracts and other commercial law courses, earning first the Best New Professor Award and subsequent recognition as Best Professor by student vote, and then he moved on to Ohio State.
Throughout his academic tenure, Mr. Whaley's most notable achievement has been preparing students for successful legal careers, including many bar exam review classes in multiple states twice yearly for over a decade. He takes great pride in former students' successful legal careers, including appointment to various levels of the judiciary in both federal and state trial and appellate courts.
His civic work includes serving as co-founder and past president of Stonewall Columbus Inc., reflecting a commitment to community involvement alongside his professional endeavors.
Mr. Whaley's contributions to legal scholarship are extensive. He is the author of "Problems and Materials on the Law of Sales," which was the first casebook ever to use the Problem method, followed by six other casebooks with numerous coauthors. His bibliography also includes three Gilberts Law Summaries, along with many law review articles, one of which was cited by the United States Supreme Court. In addition to his academic roles, Mr. Whaley is also recognized as a public speaker and a playwright. He has written fiction, authoring two novels and a number of plays, most notably "The Turkey Men," which was ranked second by The Columbus Dispatch among the 10 best professional productions of 2019 in Columbus, Ohio (the touring version of "Hamilton" took the top prize).
On a personal level, Mr. Whaley is married to David A. Vargo, and has one son from a previous marriage, Clayton Whaley.
