January 23, 2014 /24-7PressRelease/ -- Las Vegas has earned a reputation for being a city with a high marriage rate, but statistics indicate that the state of Nevada as a whole can also claim an unusually high divorce rate. As the economy recovers and couples find themselves in stronger positions financially, Nevada's already above-average rate of divorce may only become higher, which makes it important for couples who are separating to understand the process more clearly.

Recent divorce uptick reported

Studies have suggested that divorce rates may drop during times of economic strain, since divorce costs can be high and couples may have an easier time sticking it out together. Nevada's KTVN 2 News reports that such a pattern could explain trends this year, when divorce filings across the country increased by as much as 25 percent, according to estimates from industry experts. In Nevada specifically, divorce rates experienced a small decline during the recession and began increasing after.

According to the Census Bureau's most recent national and state analysis, published in 2011, Nevada had a higher divorce rate than the national average. The marriage rate also exceeded the national average, while the average marriage duration was below average. During 2009, Nevada had one of the ten highest divorce rates in the nation for men and women alike.

It is important to note that these figures were calculated based only on people residing in Nevada, not people who were married while visiting the state. With state divorce rates already above average during the recession, and with rates now increasing across the nation, many Nevada couples may soon find themselves developing a better understanding of divorce proceedings.

Filing for divorce in Nevada

Couples who wish to separate in Nevada face numerous legal considerations that must be handled during the divorce. These include:
- What the grounds for seeking the divorce are.
- Whether the marriage qualifies for an annulment or whether a legal separation might serve the couple better.
- Whether children or other complications will eliminate the possibility of an uncontested divorce settled outside of court.
- How assets will be divided and how children or the economically disadvantaged spouse will be supported.

Between navigating these hurdles and correctly filing divorce forms, it is advisable for most people to at least consult with an attorney before filing for divorce. Finding the arrangement that is optimal for each spouse as well as any children can be difficult even when the individuals see eye to eye, and when aspects of the divorce are contested, the process becomes much more complex. An attorney can help a spouse understand his or her rights as well as duties early on in the separation.

Although Nevada's divorce rate is higher than average and may rise as the economy improves, this does not mean that the process of divorcing is routine or unimportant. If you and your spouse are separating, you should speak with an attorney so that you have a better likelihood of getting a divorce settlement that you can live with.
