Umansky Firm Wins Computer Sex Crime Case

Client found not guilty after police observed him engaging in exhibitionist activities in adult chat room.



    ORLANDO, FL, July 25, 2012 /24-7PressRelease/ -- Orlando criminal defense attorney Gary Schwartz of the Umansky Law Firm achieved a not guilty verdict for a client facing charges in a computer sex crime case. The man had been inviting women he met in an 18-and-over adult chat room into a private chat room, where he would engage in exhibitionist activities over a web cam. Eventually, the police became aware of his actions and arrested him. Due to Mr. Schwartz's efforts, the client will not face criminal consequences and will avoid being labeled a sex offender.

According to the facts reported in the Seminole County Court records for case number 2011-CF-101928-A-O, the incident that led to Mr. Schwartz's client's arrest occurred when a police officer entered the chat room to look for sexual predators. The client invited the officer into a personal chat room and then began doing things to himself over his webcam. At this point, the police officer tried to imply that she was a 14 year old girl, when she was in fact a police officer. Several weeks later, the client was arrested in South Florida and charged with lewd exhibition via computer. If convicted, he would have been a registered sex offender for the rest of his life.

During the trial, Mr. Schwartz was able to convince the jury that the police acted unreasonably in this case. Since the client was in a chat room for people over the age of 18, he should be able to reasonably expect that the person on the other side of the chat was an adult, which in fact she was.
