Umansky Firm Wins Resisting Officer Without Violence Case

Charges were dropped against client who did not do anything wrong and was simply seeking more information about his friend who had just been arrested.



    ORLANDO, FL, July 25, 2012 /24-7PressRelease/ -- Orlando criminal defense attorney Gary Schwartz of the Umansky Law Firm was successfully able to get the charges against his client dropped in a resisting an officer without violence case. The client had been charged in an incident at Universal Studios in Orlando after trying to find out additional information regarding the arrest of his friend. Due to Mr. Schwartz's efforts, his client will not face the serious criminal consequences associated with resisting an officer without violence.

According to the facts reported in the Seminole County Court records for case number 2011-MM-007070-A-O, Mr. Schwartz's client was at Universal Studios with his friend when his friend was arrested for allegedly spitting on a bartender. Mr. Schwartz's client began following the arresting officer to find out what was happening. After awhile, the officer turned on Mr. Schwartz's client and swept his leg, dropping him to the ground where he cracked his head open. The officer then arrested him on charges of resisting an officer without violence.

The police officer explained his actions against Mr. Schwartz's client, including the subsequent arrest, by saying he was afraid he was about to be attacked. However, a surveillance video from Universal Studios showed that Mr. Schwartz's client was not acting aggressively at all. In fact, the police officer was roughly twice the size of the 145 pound man he took down due to the fear of being attacked.

"You have your First Amendment right to express your displeasure at law enforcement actions," said Mr. Schwartz. "Just understand that if you exercise those rights, there is a pretty good chance you will be arrested, depending on the officer." The jury agreed with Mr. Schwartz's argument that the case had no merit, and they dismissed all charges against his client.
