Texas Woman Files Lawsuit for Injuries Caused by Defective Transvaginal Mesh Implant

Fort Worth woman files lawsuit against American Medical Systems, Inc. for injuries caused by defective transvaginal mesh implant.

DALLAS, TX, August 16, 2012 /24-7PressRelease/ -- A Fort Worth woman has filed a lawsuit against transvaginal mesh manufacturer American Medical Systems, Inc. for injuries she sustained from a transvaginal surgical mesh implant. The lawsuit, filed on August 9, 2012, in U.S. District Court for the Southern District of West Virginia, is one of many cases filed as part of the developing transvaginal mesh multidistrict litigation (MDL).

In her lawsuit, the woman claims that she received the Monarc Subfascial Hammock and two Elevate Anterior and Apical Systems to treat both her pelvic organ prolapse and stress urinary incontinence. But shortly after receiving the implants, the woman claims that she began experiencing mesh protrusion, resulting in severe pain.

The lawsuit alleges that American Medical Systems, Inc. was negligent and failed to use reasonable care in designing, manufacturing, marketing, labeling, packaging, and selling its transvaginal mesh products.

The woman is also pursuing a strict liability claim against the company, asserting that the transvaginal mesh implant she received was defective in design and manufacture. Finally, the woman claims that the company failed to warn of the dangers associated with the transvaginal mesh and breached both express and implied warranties.

The woman is represented by Fort Worth transvaginal mesh injury attorney Kay L. Van Wey of Van Wey Law, PLLC, a personal injury litigation firm based in Dallas, Texas. Ms. Van Wey is Board Certified in Personal Injury Trial Law and has been named a 2012 Texas Super Lawyer for the tenth consecutive year. Thousands of women across the United States may be affected by these defective transvaginal mesh implants.

If you or a loved one received transvaginal mesh to treat pelvic organ prolapse or stress urinary incontinence and experienced complications, you may have a claim for compensation against the device manufacturer.
