This one causes many grammarians to disagree. This writer suggests the following as a consensus:

If you are talking about how business will be next year or an event expected to take place next year then no capitalization is required if the term 'new year' is used. You simply have a noun - year - modified by an adjective - new.

In the new year we expect to see a 10% increase in sales.

If you are referring to a specific day, or the 'eve' of a specific day, then capital letters are required.

New Year's Day is a federal holiday in both the US and Canada.

We are going to a New Year's Eve party tonight.

In either case, the apostrophe is mandatory; the day and the eve belong to the new year. However, the term Happy New Year's, while perhaps acceptable in colloquial speech, is technically incorrect, unless it is followed be Eve or Day.
