Anoka County, Mn Jury Finds Insurance Company Responsible for Damages

    ANOKA, MN, May 11, 2015 /24-7PressRelease/ -- On April 17, 2015, Richard Schroeder of the Law Offices of Schroeder & Mandel, PA obtained a verdict against Illinois Farmers Ins Co in excess of $600,000 from a 7-member Anoka County jury on behalf of an 83 year old man who was injured in a 2011 car crash.

Schroeder's client, an owner/operator semi-truck driver with a spotless driving record, sustained a torn rotator cuff requiring surgical repair. He was unable to return to his occupation as a truck driver. It was agreed the other driver was at fault for causing the wreck. Prior to trial, Illinois Farmers hired and paid a doctor to say the Plaintiff's injury never even occurred as a result of the 2011 crash. This was a reversal of what they had previously decided and agreed on. "We were shocked by this conduct. It just wasn't right," Schroeder said.

Illinois Farmers then disputed the at-fault driver had inadequate insurance coverage to cover the injuries and damages. In order to obtain full coverage for his injuries and damages, Schroeder's client was forced to sue Illinois Farmers Insurance for damages that include medical care and past /future loss of earnings.

"For years, my client paid premiums for coverage like this in the event he ever needed it. We were simply looking for the insurance company to stand by him, step up and honor his claim. Instead they attacked their own customer's reputation and credibility," Schroeder explained.

Underinsured Motorist coverage provides compensation for medical expenses, loss of earnings and other damages in excess of the at fault driver's insurance coverage. Schroeder concluded, "By turning their back on my client's claim, we believe the insurance company showed bad faith. Jurors heard it unfold over 2 1/2 days as we told the story of what was really going on."
