The appeal will be argued before Circuit Judges Ambro, Hardiman and Nygaard. The Settlement currently resides in the U.S. Court of Appeals for the 3rd Circuit; the hearing will start at 9:30 a.m. ET, and will take place in The Albert Branson Maris Courtroom in Philadelphia, Pa.

Previously, those who appealed the Settlement reached between the NFL and the attorneys representing the retired NFL players were given until Sept. 15 to file their reply briefs, and until Sept. 30th to respond. The next step is for the U.S. Court of Appeals to hear oral arguments from counsel before they render their decision.

Professor Samuel Issacharoff will Present Arguments on Behalf of Retired Players; Argument will Focus on CTE Diagnosis

Professor Samuel Issacharoff, known for his distinguished work on the Deepwater Horizon class litigation, will argue on behalf of ten retired NFL players involved in the settlement who have filed appellate briefs opposing the approved Settlement agreement. These appeals are based on the belief that the Settlement agreement is currently constructed unfairly and excludes former players who have yet to be diagnosed with CTE (Chronic Traumatic Encephalopathy).

CTE is a progressive degenerative disease of the brain found in those with a history of repetitive brain trauma, including symptomatic concussions and asymptomatic sub-concussive hits to the head. Currently, the NFL settlement only recognizes a CTE diagnosis that is based upon an autopsy after death; the agreement does nothing for thousands of players who are currently suffering from concussion-related symptoms that may eventually develop into neurological diseases -- and for those who may be diagnosed with CTE after death.

Paul Clement, former U.S. Solicitor General, will present oral arguments on behalf of the NFL.
