U.S. Court of Federal Claims Finds in Favor of Petitioner Represented by Associate Attorney Vanessa Brice in Vaccine Injury Case

Claimant developed Guillain-Barre syndrome after receiving flu shot

The flu vaccine is generally safe and the benefits outweigh the risks, [...] an extremely small percentage of people have developed Guillain-Barre syndrome after getting the flu vaccine.

ORLANDO, FL, January 20, 2016 /24-7PressRelease/ -- Colling Gilbert Wright & Carter announced Wednesday that a client represented by the firm was awarded $200,000 in damages after developing a neurological disorder resulting from the administration of a flu shot. Vanessa Brice, an associate attorney at Colling Gilbert Wright & Carter, represented petitioner Ova Franklin Kelly in a case appearing before the U.S. Court of Federal Claims.

The decision was recently published on Leagle.com.*

Brice petitioned the government on Kelly's behalf for damages under the National Vaccine Injury Compensation Program. Established in 1988, this program seeks to provide recompense to patients who suffer adverse effects after receiving certain vaccinations, including vaccines containing the influenza virus.

Guillain-Barre syndrome causes the body's immune system to attack the nerve cells, resulting in muscle weakness and paralysis. According to the Centers for Disease Control and Prevention, some patients experience long-term nerve damage as a result of Guillain-Barre syndrome.

"Although the flu vaccine is generally safe and the benefits outweigh the risks, particularly for the elderly and immune-compromised, an extremely small percentage of people have developed Guillain-Barre syndrome after getting the flu vaccine," Brice said.

Attorneys who represent petitioners in vaccine compensation cases must be admitted to practice before the U.S. Court of Federal Claims. Through a complicated administrative process, the lawyer must prove that her client suffered a disease known to occur from certain vaccines and demonstrate the physical and economic damages suffered by the petitioner.
