The H1b Visa Deadline is Only a Month Away

The H1b visa for people with a 4-year degree or equivalent have one month left to locate an employer offering a specialty-occupation position in that person's profession, a lawyer, and file their case.



With respect to the fact that many qualified applicants will apply for the H1b visa but not obtain it, there are other options available for persons from certain countries.

Even if they win there is no guarantee they will obtain their visas as the demand for H1bs exceeds the supply.

In the 'olden days', not that far back, one could obtain the visa any time of year by locating a sponsoring employer and filing a case. Things have changed dramatically, states Mr Riznyk. Now, if an application is not in by April 1st, a person has no chance as there are so many applications submitted that they are over-exhausted in one day. The government, having received all of the applications, then has a lottery that chooses the lucky ones who can obtain a visa from all of the successful H1b applications.

Although the H1b has a maximum duration of only 6 years, it is a pathway to a Green Card. A person with an H1b visa can then be a beneficiary of a Green Card petition filed by an employer, based on a full-time job offer. Under certain circumstances, the H1b will be extended year after year if an immigrant visa number is not currently available. The job offer can be from the same employer or a different one. The catch, however, is that the H1b job offer must be for a temporary position, not a permanent one. Employers often have difficulty demonstrating that the position is temporary when they are filing for a Green Card at the same time for the same position.
