California Homeschool Ruling to Be Reheard by Court of Appeal

Less than one month after handing down a bad decision on homeschooling, the Court of Appeal of the State of California has granted a rehearing of In re Rachel L. Oral arguments to be heard in June. The court has invited Sunland Christian School to file an Amicus Curiae brief.

Sunland Christian School is a California private school founded in 1986 by Terry Neven with 24 students. Today, Terry and Laura Neven, have served over 3000 families, and Sunland Christian graduates have gone on to attend universities, such as Harvard, University of Southern California, University of Oklahoma, University of Illinois, and many more. Sunland Christian School has exclusively offered homeschooling as its educational program during it past 22 years of service. After being evaluated by the Los Angeles Unified School District in 1986 and again in 1989, Terry Neven and Sunland Christian School were deemed a legally qualified private school in the State of California.

Sunland Christian School's legal representation, Pacific Justice Institute, will fully interact in the rehearing and will continue to file a motion to intervene with the California Supreme Court The Court of Appeal had labeled Sunland Christian School as a ruse, in its first ruling, and will be revisiting this point during the rehearing.

In the early 1990s, Terry Neven had become a member of the California Association of Supervisors of Child Welfare and Attendance (formerly referred to as truant officers), and participated in state and local conferences, interacting with key public school officials who had once been against homeschooling.

In 1992, Sunland Christian School was evaluated, this time by the Los Angeles County Office of Education and found to "meet the requirements for a private school in California and students enrolled meet California compulsory education laws." The issue concerning Sunland Christian School's homeschool program had been the main focus of this evaluation.

Terry Neven developed Sunland Christian School's program to assist families looking for an alternative to public and private schools. Sunland Christian's program involves evaluating the student's academic status and learning style, developing a curriculum to meet each student's specific course of study and learning needs, supervise and assist the parents in instructing their children, providing accountability, record keeping and extra-curricular activities. Terry, along with his wife, Laura Neven, who also helps run the school, signs work permits, concurrent college registration forms, Driver Education Certificates of Completion and various other legal documents to assist students in their education and social interactions.
