New Jersey Student Reaches $699,000 Settlement Following Serious Injury During High School Dodgeball Game

    HAMILTON TOWNSHIP, NJ, September 07, 2022 /24-7PressRelease/ -- The Law Offices of Greg Prosmushkin, P.C., a leading personal injury law firm, is proud to announce we have reached a $699,000 settlement for our client who was seriously injured during a high school dodgeball game.

Our client, who was a senior at Hamilton High School West in Hamilton Township, New Jersey, filed a lawsuit against the school district after she was seriously injured during a physical education class. At the time, she had recently received a shunt that was placed in her head to correct symptoms of pseudotumor cerebri, a condition that causes high pressure in the skull and mimics symptoms of a tumor. She was also under strict doctor's orders to avoid contact sports.

Despite her medical condition, we argued that her teacher forced her to participate in the dodgeball game "protect the castle" despite our client's concerns and protests. During the game, our client was struck in the head with a ball, fell backward and hit her head on a set of bleachers. This resulted in serious and permanent injuries to our client.

We argued in the lawsuit that the school district should have ensured teachers and staff do not require students to engage in or perform activities that needlessly endanger them or place them at unnecessary risk of harm. The settlement was reached on Jan. 27, 2022.

As a result of the lawsuit, the Hamilton Township School District has also reviewed and made improvements to the administration of 504 plans, which offer support and accommodations for students with disabilities. The district's 504 administrators have been directed to communicate any new 504 plans or changes with students to improve checks and balances regarding the communication of new plans or changes to existing ones.
